Genius Gems Party/Event Waiver and Agreement
By booking a party or event at Genius Gems Chelsea, LLC (the “Company”), the host agrees to the following terms on behalf of its guests, and any staff or chaperones (collectively, the “Participants”) for any field trip, class, party, or event (the “Activity”):
Acknowledgment of Risks
The host understands that while Genius Gems takes reasonable safety precautions, certain STEM activities may involve inherent risks including minor injury, illness (including COVID-19), or property damage. The host voluntarily assumes these risks for all Participants. Unsafe behavior such as running, jumping, throwing, climbing, or damaging equipment is strictly prohibited and may result in immediate removal.
Waiver and Release of Liability
To the fullest extent permitted by law, the host waives and releases any claims against the Company and its staff, affiliates, and representatives arising from participation in the Activity, whether due to negligence or otherwise. The host family agrees not to hold the Company liable for any injuries, damages, or losses that may occur.
Indemnification
The host agrees to indemnify and hold harmless the Company from any claims, losses, or legal fees arising out of the actions or behavior of its students, staff, or chaperones.
Media Consent
Guests may be photographed or filmed during the Activity. These images may be used by Genius Gems in promotional or marketing materials unless the host notifies us in writing in advance of the visit.
Cancellation Policy
By confirming a booking, the host agrees to abide by Genius Gems' cancellation and rescheduling policy, as outlined at the time of booking.
Governing Law and Jurisdiction
This Agreement is governed by the laws of the State of New Jersey. Any disputes shall be resolved in courts located in New Jersey.
By booking and participating in the Activity, the host confirms that it has read, understood, and agrees to all terms above on behalf of all Participants.
